These Terms and Conditions (“Terms”) govern your use of our website and services provided by INKWALA (“we,” “us,” “our”). By accessing or using our website (the “Site”) and purchasing products from us, you agree to be bound by these Terms.
Our online store is hosted on WooCommerce. They provide us with the online e-commerce platform which allows us to sell our products and services to you. The printing, shipping, and handling of our apparel and art prints is fulfilled by Printful.
1. Use of the Site
1.1. You must be at least 18 years old to use this Site and to purchase products from us.
1.2. You agree to provide accurate, current, and complete information during the registration and checkout process.
1.3. You are responsible for maintaining the confidentiality of your account information and password and for restricting access to your computer.
2. Products and Services
2.1. INKWALA offers digital products to download. We also work with partner services to fulfill our print on demand products, such as apparel and art prints.
2.2. All products are subject to availability, and we reserve the right to limit the quantities of any products or services that we offer.
3. Digital Downloads
3.1. By purchasing a digital product, you are granted a non-exclusive, non-transferable, revocable license to download and use the digital product for personal, non-commercial use only.
3.2. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the digital products without express written permission from us.
4. Order and Payment
4.1. All orders placed through our Site are subject to acceptance by us.
4.2. We accept various forms of payment, as indicated on our Site. You agree to pay all charges incurred by you or any users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred.
5. Shipping and Delivery
5.1. Digital products are instantly available for download at checkout. You will also receive an email providing a limited download link.
5.2. For physical products, shipping costs and delivery times will vary based on your location and selected shipping method. Detailed shipping guidelines will be provided during the checkout process.
5.3. We are not responsible for any delays in shipping due to carrier issues, customs, or any other unforeseen circumstances.
5.4. Shipping Policy from Printful, our print on demand service for apparel and art prints:
Usually, it takes 3–7 days to fulfill an order, after which it’s shipped out. The shipping time depends on your location, but can be estimated as follows:
- USA: 3–4 business days
- Europe: 6–8 business days
- Australia: 2–14 business days
- Japan: 4–8 business days
- International: 10–20 business days
International shipping:
International shipments may incur customs fees. For each country the customs policy is different, and the fee is usually based on a variety of factors like weight, value, and size. We do not take responsibility for customs fees.
6. Returns and Refunds
6.1. Digital Products : Due to the digital nature of our products, all sales of digital downloads are final and non-refundable.
6.2. Physical Products: For physical products, please refer to our Return and Refund Policy for more information.
7. Limitation of Liability
7.1. To the maximum extent permitted by applicable law, INKWALA shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our products or Site.
7.2. Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount paid by you for the products.
8. Governing Law
8.1. These Terms shall be governed by and construed in accordance with the laws of Quebec, Canada, without regard to its conflict of law principles.
8.2. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Quebec, Canada, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
9. Changes to Terms
9.1. We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our Site.
9.2. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
